If you publish your weblog in Germany and consider using Blogad classifieds to earn some extra cash, be advised that by doing so, you turn your weblog into a commercial website (§6 Teledienstgesetz) and are therewith obliged to publish your "Impressum" (or Imprint).

Of course, this stiuation brings up the question of what it means to "publish your weblog in Germany." Does it mean the server resides in Germany, or does it mean that the weblog is available in Germany?

Good question, Joe. I am not a legal professional, but if your site is a) hosted in Germany or b) you live in Germany and you are therewith not c) immune from German legislation, I would consider putting the Impressum link on your site.

Your are right about the imprint stuff for German blogs that want to generate revenue through blogads, but I'd doubt that the program will be successful on the German market. The online advertising budgets are still kinda tight and the media agencies will probably not go through an English advertising network to target German users.

The physical location of the server is usually irrelevant, otherwise anyone wanting to avoid prosecution could just host their sites in some dodgy pacific archipelago or whereever the legislation is more lenient. The key question is typically where you are based and who the site is targeted at. See also §4 TDG.

Well, yes, you can't avoid possible prosecution by hosting in a foreign country. But if you live abroad, and host in Germany, you can get sucked into the mess.
